Termos de Serviço/Terms of ServicePT-BR1. ObjetoEste termo de serviço (doravante denominado “Termo”) tem como objetivo estabelecer as condições gerais para a prestação de serviços de criação de pixel art (doravante denominados “Serviços”) pelo prestador de serviços (doravante denominado “Prestador”) ao cliente (doravante denominado “Cliente”).2. Serviços2.1. O Prestador se compromete a criar uma obra de arte digital no formato pixel art, conforme as especificações e requisitos do Cliente, estabelecidos em um briefing inicial.2.2. O Cliente se compromete a fornecer ao Prestador todas as informações necessárias para a execução dos Serviços, incluindo, mas não se limitando a: referências visuais, descrição detalhada da obra, paleta de cores e prazo de entrega.3. Pagamento3.1. O Cliente deverá efetuar o pagamento de 50% (cinquenta por cento) do valor total dos Serviços como sinal de início do projeto.3.2. O restante do pagamento deverá ser efetuado antes da entrega da obra final.3.3. Os valores serão definidos em um orçamento detalhado, enviado ao Cliente antes do início dos Serviços, o pagamento pode ser feito por meio do Pix ou PayPal.4. Prazo de Entrega4.1. O prazo de entrega da obra final será definido em conjunto com o Cliente, levando em consideração a complexidade do projeto e a disponibilidade do Prestador.4.2. O Prestador se esforçará para cumprir o prazo estabelecido, porém, imprevistos podem ocorrer e o prazo poderá ser ajustado, desde que haja comunicação prévia ao Cliente.5. Direitos Autorais5.1. A autoria da obra criada pertence ao Prestador, que concede ao Cliente uma licença de uso não exclusiva para fins pessoais ou comerciais, conforme acordado entre as partes.5.2. O Cliente deverá creditar o Prestador como autor da obra em qualquer utilização da mesma, além de não remover a marca d'água da arte.6. Alterações6.1. O Cliente poderá solicitar alterações na obra durante o processo de criação, sendo que o número de alterações será definido em conjunto com o Prestador.6.2. Alterações significativas que excedam o escopo inicial do projeto poderão gerar custos adicionais.7. Confidencialidade7.1. O Prestador se compromete a manter sigilo sobre todas as informações confidenciais do Cliente, relacionadas ao projeto.8. Resolução8.1. Este Termo poderá ser rescindido por qualquer uma das partes, mediante notificação prévia à outra parte, com antecedência mínima de 3 (três) dias.8.2. Em caso de rescisão por parte do Cliente, o valor já pago para o início do projeto não será reembolsado caso o projeto já tenha sido iniciado.9. Foro9.1. Fica eleito o foro da comarca de TJRJ para dirimir quaisquer litígios decorrentes deste Termo.10. PurposeThis Terms of Service (hereinafter referred to as the “Terms”) establishes the general conditions for the provision of pixel art creation services (hereinafter referred to as the “Services”) by the service provider (hereinafter referred to as the “Provider”) to the client (hereinafter referred to as the “Client”).2. Services2.1. The Provider agrees to create a digital artwork in pixel art format, according to the Client's specifications and requirements, as established in an initial brief.2.2. The Client agrees to provide the Provider with all information necessary for the performance of the Services, including but not limited to: visual references, a detailed description of the work, color palette, and delivery deadline.3. Payment3.1. The Client shall pay 50% (fifty percent) of the total value of the Services as a down payment to start the project.3.2. The remaining payment shall be made before the final delivery of the work.3.3. The values will be defined in a detailed budget, sent to the Client before the start of the Services. Payment can be made via PayPal.4. Delivery Deadline4.1. The delivery deadline for the final work will be defined in conjunction with the Client, taking into account the complexity of the project and the Provider's availability.4.2. The Provider will strive to meet the established deadline, however, unforeseen events may occur and the deadline may be adjusted, provided that the Client is notified in advance.5. Copyright5.1. The authorship of the created work belongs to the Provider, who grants the Client a non-exclusive use license for personal or commercial purposes, as agreed upon by the parties.5.2. The Client shall credit the Provider as the author of the work in any use thereof, and shall not remove the watermark from the art.6. Changes6.1. The Client may request changes to the work during the creation process, and the number of changes will be defined in conjunction with the Provider.6.2. Significant changes that exceed the initial scope of the project may incur additional costs.7. Confidentiality7.1. The Provider agrees to keep confidential all of the Client's confidential information related to the project.8. Termination8.1. This Agreement may be terminated by either party upon prior notice to the other party, with a minimum notice of 3 (three) days.8.2. In the event of termination by the Client, the amount already paid for the start of the project will not be refunded if the project has already been initiated.9. Jurisdiction9.1. The Court of the State of Rio de Janeiro shall be the forum for resolving any disputes arising from this Agreement.10.
